What are the legal requirements of Auto Insurance burden of proof?

A friend was struck in the side directly by a larger vehicle. The friend had the right of way as the truck was exiting a parking lot. The truck was not damaged but the friend's car was crushed in on the driver side rear door. The police assigned fault to the driver of the truck. That driver had 'insurance' but no license. The insurance company of the driver of the truck refuses to pay for damages, saying that the police wrongfully placed their driver at fault because he didn't speak english and didn't have a license. The friend's insurance company is refusing to pay for it or put up a fight against the other company.
